Mitigate your (human) Costs of Litigation: Think Mediation

There is a cost of litigation very few lawyers will warn you about: the human cost.  It should be considered just as much as the monetary costs.  It is a cost your insurance will not cover and you will not get it reimbursed by the other party either. In your business, having a dispute can be a huge distraction for your organisation. While I can concede that the human impact and indirect cost of a litigation for your enterprise is difficult to quantify, it should nevertheless be considered by the management before pursuing proceedings. Is time better spent on growing the business or on this battle?

Dealing with cross-border dispute resolution between Estonia and Finland

Estonia and Finland have a very close relationship when it comes to business connections between the two countries. However, also due to this close relationship, it is easy to forget that the jurisdictions in those neighbouring countries are different and therefore, before signing, all agreements should be reviewed from another angle, taking into account the question about the governing law and dispute resolution. If this is not done before the agreement is signed, it may later be difficult to determine what the applicable law is and how to start legal actions.

The Amicable Shark – How to Solve Disputes in Finland?

When I moved to Finland, one of my cultural shocks was how non-confrontational Finns are.  I was both surprised and disappointed that the Finns did not seem to fully appreciate the value of having a tough conversation.   Instead most Finns seem to find expressing one's dissatisfaction directly to the person having caused it so uncomfortable that they would resort to it only in extreme situations.
